Terms of Service

1. Agreement to these terms
By downloading, installing, or using Vidpop (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Yousef Zaki, the individual developer operating Vidpop ("Vidpop," "we," "us," or "our").
2. Eligibility and age requirement
You must be at least 18 years old to use Vidpop. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. If you are under 18, do not use the Service. We do not knowingly provide services to minors. If we discover that a user is under 18, we will terminate their account immediately.
3. License to use the Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Vidpop for your personal or commercial purposes, subject to these Terms and Apple's standard App Store EULA.
You may not: (a) sublicense, sell, resell, or distribute the app itself; (b) reverse engineer, decompile, or disassemble any part of the Service; (c) use the Service to build a competing product; or (d) remove any proprietary notices from the Service.
4. Ownership of generated content
4.1 You own your output
As between Vidpop and you, you own all rights in the scripts, images, voiceovers, and videos generated through the Service using your inputs ("Output").
4.2 License back to us
You grant Vidpop a non-exclusive, worldwide, royalty-free license to store, process, and transmit your inputs and Output solely as necessary to provide the Service to you. We do not use your content to train AI models, and we do not share your Output with other users.
4.3 Non-exclusivity of AI output
Because Vidpop uses AI systems shared across users, we cannot guarantee that your Output will be unique. Other users who provide similar inputs may receive similar or identical results. We make no representations as to the uniqueness, originality, or intellectual property status of any generated content. You are responsible for verifying that your intended use of Output does not infringe third-party rights.
4.4 Restriction on AI training
Output generated through Vidpop may not be used to train, fine-tune, or develop third-party artificial intelligence models, systems, or networks without our express written consent.
5. Your responsibilities and acceptable use
5.1 Review of generated content
IT IS YOUR SOLE RESPONSIBILITY TO REVIEW ALL AI-GENERATED CONTENT — INCLUDING SCRIPTS, IMAGES, VOICEOVERS, AND VIDEOS — BEFORE PUBLISHING OR DISTRIBUTING IT. VIDPOP DOES NOT REVIEW GENERATED CONTENT FOR ACCURACY, LEGALITY, OR APPROPRIATENESS.
5.2 Third-party app metadata
Vidpop retrieves publicly available information from the Apple App Store, including app names, descriptions, and icons, to assist you in creating promotional content. This data is provided by Apple and third-party developers. You are solely responsible for ensuring your use of third-party trademarks, logos, app names, and other IP in generated videos complies with applicable law and does not infringe any third party's rights. Vidpop disclaims all liability for claims arising from your use of third-party app metadata.
5.3 Upstream acceptable use policies
Vidpop is built on third-party AI services, each of which has its own Acceptable Use Policy. By using Vidpop, you agree that your use of AI features is also subject to:
- OpenAI's Usage Policies (for script and image generation)
- HeyGen's Terms of Service and Content Policy (for AI avatar video)
- ElevenLabs' Terms of Service (for AI voiceover)
You may not use Vidpop to generate content that would violate any of these upstream policies. Violations may result in immediate suspension or termination of your access to affected features or to the Service entirely.
5.4 Prohibited content
You may not use Vidpop to generate or distribute content that:
- Is defamatory, harassing, threatening, or abusive toward any person
- Depicts or promotes violence, illegal activity, or self-harm
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property right
- Contains the likeness, voice, or personal information of any real person without their express consent (including deepfakes)
- Is sexually explicit or obscene
- Constitutes spam, misleading advertising, or fraudulent misrepresentation
- Violates any applicable law or regulation
6. Payments, subscriptions, and refunds
6.1 Apple In-App Purchase
All purchases — including subscriptions and credit packs — are processed by Apple Inc. through the App Store. Vidpop does not process payments directly and does not have access to your payment information. By making a purchase, you agree to Apple's App Store Terms of Service.
6.2 Subscriptions and auto-renewal
Subscription plans automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price. You can manage or cancel your subscription at any time through your Apple ID Account Settings (Settings → Apple ID → Subscriptions).
6.3 Credits
Credit packs are non-refundable and non-transferable. Unused credits have no cash value. Credits may expire as disclosed at time of purchase. We reserve the right to adjust credit pricing and packages with reasonable notice.
6.4 Refunds
All sales are processed by Apple and are subject to Apple's refund policies. Vidpop does not issue independent refunds for App Store purchases. To request a refund, use Apple's standard refund process at reportaproblem.apple.com. We may, at our sole discretion, issue goodwill credits for documented service failures.
6.5 Price changes
We may change subscription prices. We will provide at least 30 days' notice before any price increase takes effect, via in-app notice or email. Your continued subscription after the effective date constitutes acceptance of the new price.
7. Disclaimer of warranties
THE SERVICE, INCLUDING ALL AI-GENERATED SCRIPTS, IMAGES, VOICEOVERS, AND VIDEOS, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. VIDPOP DOES NOT WARRANT THAT GENERATED CONTENT WILL BE FREE FROM ERRORS, BIASES, OR DEFECTS, OR THAT IT WILL MEET YOUR SPECIFIC REQUIREMENTS.
AI-generated content may present anomalies, inaccuracies, or unintended results. You acknowledge and accept this inherent limitation of AI systems. The Service depends on third-party AI providers; we are not liable for their downtime, errors, or policy changes.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIDPOP AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In no event will Vidpop's total cumulative liability to you exceed the greater of: (a) the total amount you paid to Vidpop in the 12 months preceding the event giving rise to the claim, or (b) $100 USD.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability is limited to the minimum extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Vidpop, its developer, officers, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of or access to the Service
- Your inputs, prompts, or content submitted to the Service
- Any Output you generate, publish, or distribute
- Any claim that your Output infringes the intellectual property, privacy, publicity, or other rights of any third party
- Your violation of these Terms or any applicable law or regulation
- Your use of third-party app names, icons, or descriptions obtained through the Service
10. Intellectual property
Vidpop, including its name, logo, app design, source code, and original content, is owned by Yousef Zaki and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights in Vidpop's intellectual property beyond the limited license in Section 3.
The AI-generated avatars rendered through HeyGen are subject to HeyGen's licensing terms. We make no representation that you acquire any rights in the underlying avatar models, voice models, or other third-party AI assets used to generate your Output.
11. Termination
We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or if we determine, in our sole discretion, that your use of the Service is harmful, illegal, or violates the acceptable use policies of any upstream service provider.
You may stop using the Service at any time and cancel your subscription through your Apple ID Account Settings. Termination does not entitle you to a refund of any unused subscription time or credits, except as required by applicable law or Apple's refund policies.
Sections 4, 7, 8, 9, 10, and 13 of these Terms survive any termination.
12. Modifications to the Service and Terms
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms at any time. Material changes will be communicated via in-app notice or email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the Service.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.
Informal resolution first: Before filing any legal claim, you agree to contact us at support@vidpop.app and give us 30 days to attempt to resolve the dispute informally.
14. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vidpop regarding the Service.
- Severability: If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force.
- No waiver: Our failure to enforce any provision of these Terms is not a waiver of that provision.
- Apple EULA: This Service is provided through the Apple App Store. Apple is not a party to these Terms and has no obligation to provide support for the Service. In the event of any conflict between these Terms and Apple's Media Services Terms and Conditions, Apple's terms govern solely with respect to the App Store relationship.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely.
